Terms of Service

Welcome to TerraGPT. These Terms of Service (the "Terms") are a binding agreement between you and TerraGPT ("TerraGPT", "we", "us") covering your use of the TerraGPT websites, web application, mobile applications, and related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. What TerraGPT is

TerraGPT is an AI-powered assistant. You send messages and the Service generates responses, images, documents, and related outputs. TerraGPT routes requests across efficient computing infrastructure, and at message milestones we pledge tree planting through established reforestation partners, at rates that depend on your plan.

Tree planting is carried out by third-party reforestation organizations we contract with. Planting figures shown in the Service reflect pledges made under those programs. While we choose partners carefully and report numbers honestly, planting schedules, locations, species, and survival rates are managed by those partners in the field.

2. Who can use the Service

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with the consent of a parent or legal guardian who agrees to these Terms on your behalf. By using the Service you represent that you meet these requirements and that any registration information you provide is accurate.

3. Your account and the newsletter

You sign in with a supported identity provider. You are responsible for activity that happens under your account and for keeping access to your sign-in method secure. Tell us promptly at [email protected] if you believe your account has been compromised.

Creating an account subscribes you to the TerraGPT newsletter: occasional emails about product updates and the planting program. You can unsubscribe at any time using the link in any newsletter email, and unsubscribing has no effect on your account or subscription.

4. Plans, trials, and billing

The Service offers a free tier with usage limits and paid subscription plans with expanded capabilities and higher tree-planting rates. Current prices, features, and planting rates are shown at the point of purchase. We may change prices or plan features prospectively; changes do not apply retroactively to a billing period you have already paid for.

Where a plan describes a feature as "unlimited", that means unlimited for ordinary, personal use and is subject to fair use. To keep the Service fast, fair, and sustainable for everyone, we apply reasonable safeguards, including rate limits, rolling usage windows, and abuse protections, and we may set, adjust, or remove quotas, usage limits, and individual features at any time. We may also limit, throttle, or suspend usage that is automated, that materially exceeds normal individual use, or that is abusive.

  • Free trial. New subscriptions may include a 3-day free trial. You will not be charged if you cancel before the trial ends; otherwise the subscription price is charged when the trial expires.
  • Billing. Subscriptions are billed either through the Apple App Store (for purchases made in the iOS app) or by card through our payment processor (for purchases made on the web). Each subscription renews automatically at the end of its billing period until cancelled.
  • Cancellation. You can cancel at any time, in your Apple subscription settings for App Store purchases, or from your account settings for web purchases. Cancellation takes effect at the end of the current billing period, and you keep access until then.
  • Refunds. For App Store purchases, refunds are handled by Apple under Apple's policies. For web purchases, payments are non-refundable except where required by law; where you have a statutory right of withdrawal, you acknowledge that the Service is supplied immediately and consent to any consequent loss of that right to the extent permitted by law.
  • Taxes. Prices may be shown inclusive or exclusive of applicable taxes depending on your region; any applicable VAT or sales tax is either included or added at checkout as indicated.

5. Acceptable use

Use the Service lawfully and decently. In particular, you agree not to:

  • use the Service for anything illegal, or to plan, promote, or carry out harm to any person;
  • generate or distribute content that is defamatory, harassing, exploitative of minors, or that violates another person's privacy or rights;
  • attempt to breach, probe, overload, or circumvent the Service's security, rate limits, or usage restrictions, including by automated account creation;
  • scrape the Service, resell access to it, or use it to build a directly competing service;
  • reverse engineer the Service except to the extent a law expressly permits it despite this restriction;
  • misrepresent AI-generated output as human-authored where that matters (for example in academic or professional settings), or use output to mislead others;
  • upload content you have no right to share, including files containing other people's personal data without a lawful basis.

We may set, vary, and enforce usage limits, including rate limits, rolling usage windows, monthly quotas, and fair-use thresholds, to keep the Service fast, fair, and sustainable for everyone. Features described as "unlimited" are for ordinary personal use and do not permit automated, bulk, or abusive usage; we may throttle, suspend, or limit access that is automated, that materially exceeds normal individual use, or that degrades the Service for others.

6. Your content and AI output

You keep whatever rights you hold in the content you submit ("Input") . To operate the Service we need a limited licence: you grant us the right to host, process, transmit, and display your Input and the resulting output as necessary to provide, secure, and improve the Service, consistent with our Privacy Policy.

Subject to your compliance with these Terms, and to the extent we hold any rights in it, we assign to you our rights in the output the Service generates for you. Because AI systems produce similar output for similar prompts, output may not be unique to you, and we cannot guarantee it does not resemble output generated for others.

Sharing a conversation creates a public, read-only snapshot of that conversation as it exists at that moment. Anyone with the link can view it. You are responsible for what you choose to share, and you can revoke a shared link at any time from the Service.

7. AI output can be wrong

Artificial intelligence generates plausible text, images, and documents. It does not guarantee true ones. Output may be inaccurate, incomplete, outdated, or biased, and may not reflect real people, places, or events. Output is not professional advice. Do not rely on the Service as a substitute for advice from a qualified professional in medical, legal, financial, tax, safety, or other high-stakes matters, and verify important information independently before acting on it.

Environmental figures shown in the Service (such as water and energy estimates) are good-faith estimates derived from published research and our own measurements. They are illustrative, not audited measurements.

8. Our intellectual property

The Service, including its software, design, branding, artwork, and text other than your Input and your output, is owned by TerraGPT or its licensors and is protected by intellectual-property laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Service as intended by these Terms. No other rights are granted. "TerraGPT" and the TerraGPT leaf mark may not be used without our prior written permission.

9. Suspension, termination, and discontinuation

You can stop using the Service, or delete your account from settings, at any time.

We may suspend, restrict, or terminate your access to the Service, or ban your account, at any time and at our sole discretion, including for violation of these Terms, suspected abuse or fraud, risk to other users or to the Service, or where the law requires it. Where reasonable we will tell you why, but we are not obliged to give prior notice.

We may also modify, suspend, or permanently discontinue the Service, or any part of it, at any time. If we discontinue paid features entirely, we will provide a pro-rata refund of any prepaid fees covering the period after discontinuation, which is your sole remedy for discontinuation. Trees already pledged stay pledged.

Sections that by their nature should survive termination (including content licences already granted, disclaimers, liability limits, and governing law) survive it.

10. Changes to these Terms

We may modify these Terms and the Privacy Policy at any time, without individual notice to you. The current version is always published on this page with its "Last updated" date, and material changes may additionally be announced in the Service. Your continued use of the Service after a change takes effect constitutes acceptance of the modified Terms. If you do not accept a change, stop using the Service and, if applicable, cancel your subscription.

11. Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, availability, and accuracy of output. We do not warrant that the Service will be uninterrupted, error-free, or secure. Nothing in these Terms limits warranties or guarantees that applicable consumer-protection law does not allow to be limited.

12. Limitation of liability

To the maximum extent permitted by law: (a) we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill; and (b) our total aggregate liability arising out of or relating to the Service is limited to the greater of the amount you paid us for the Service in the twelve months before the event giving rise to the claim, or fifty euros (EUR 50).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, for fraud, or for intentional misconduct or gross negligence where such limits are not permitted. If you use the Service as a consumer, you keep every right your local mandatory consumer law gives you.

13. Indemnity

If you use the Service in breach of these Terms or in violation of law and that use leads to a third-party claim against us, you will, to the extent permitted by the law that applies to you, indemnify us for the resulting damages and reasonable costs. This section does not apply to consumers where such indemnities are not enforceable.

14. Governing law and disputes

These Terms are governed by the laws of the member state of the European Union in which TerraGPT's operating entity is established, without regard to conflict-of-law rules, except that if you are a consumer habitually resident in the EU/EEA or UK, you also enjoy the protection of the mandatory provisions of the law of your country of residence, and you may bring proceedings in your local courts.

Before going to court, please contact us at [email protected]. Most issues can be resolved quickly and informally. EU consumers may also use the European Commission's Online Dispute Resolution platform.

15. Everything else

These Terms, together with the Privacy Policy and any plan-specific terms shown at purchase, are the entire agreement between you and us for the Service. If a provision is found unenforceable, the rest remains in effect. Our not enforcing a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. For questions about these Terms, write to [email protected].
